What to do?

The university encourages open communication and active feedback from its employees. Complaints and reports are an important tool for identifying problems and improving the working environment.

If you encounter a situation that you consider inappropriate, unethical, unfair, or in violation of legal regulations or internal policies, we recommend that you submit a complaint or report your concern.

This may include, for example, inappropriate behaviour, discrimination, harassment, conflicts of interest, violations of internal policies, or any other matter that requires investigation.

Complaint is a submission through which you may seek protection of rights or legally protected interests that you believe have been violated by an act or omission of Pavol Jozef Šafárik University in Košice (UPJŠ). At the same time, it identifies specific deficiencies, in particular violations of legal regulations, the remedy of which falls within the competence of UPJŠ.

The Compliance Officer at UPJŠ is responsible for handling and resolving complaints submitted to UPJŠ and is required to process such complaints in accordance with Act No. 9/2010 Coll. on Complaints, as amended.

A complaint must be legible and comprehensible, and it must clearly state against whom it is directed, what deficiencies it identifies, and what the complainant is seeking. The complaint must include the complainant’s first name, surname, and address. If the complaint is submitted in paper form, it must also bear the complainant’s handwritten signature. If submitted electronically, it must be authorised or submitted via an access point (otherwise, the complainant must confirm it with a handwritten signature or authorise it within 5 working days). Anonymous complaints will not be investigated and will be closed without further action.

A submission is assessed based on its content.

Under the Complaints Act, a submission does not constitute a complaint if it:

– is in the nature of an inquiry, statement, opinion, request, initiative, or proposal;

– points out specific deficiencies in the activities of an organisational unit of UPJŠ, where the remedy or handling of such deficiencies is governed by a specific regulation (e.g. the Code of Criminal Procedure or the Administrative Procedure Code);

– constitutes a complaint under a specific regulation;

– is directed against a decision issued by UPJŠ in proceedings under a specific regulation (e.g. Act No. 71/1967 Coll. on Administrative Proceedings (Administrative Procedure Code), as amended);

– is directed against the findings of an inspection, audit, supervision, oversight, or investigation carried out under a specific regulation; or

– contains classified information, or where it is evident from its content that handling it as a complaint under the Complaints Act would result in the disclosure or jeopardising of classified information protected under a specific regulation. Complaints are handled in accordance with Rector’s Decision No. 20/2023 on the Handling of Complaints.

All complaints received are handled with an appropriate level of confidentiality. Personal data are processed in accordance with applicable legislation and the university’s internal policies.
